Definitions
"We" and "us" mean Home Fitness Company Australia. "You" means the person or organisation placing the order. "Goods" means the products you have ordered.
Use of the website
You may use this website for lawful purposes only. You agree not to interfere with its operation or security, not to attempt unauthorised access to our systems, and not to copy or republish our content, images or branding without our written permission. By ordering you confirm that you are 18 or older, or using the site with a parent or guardian.
Orders
Placing an order is an offer to buy. That offer is accepted when we dispatch the goods, and that is when the contract is made. If we cannot supply something you have ordered, or we find a pricing error on an order you have placed, we will tell you and either confirm the correct price with you before dispatch or refund you in full. We may refuse or cancel an order where we suspect fraud; if you have paid, you are refunded in full.
Prices and payment
Prices are shown in Australian dollars and are the amount you pay for the goods. Delivery, where it applies, is shown separately in the cart before you pay.
Payment is due in full at checkout and is taken through Stripe or PayPal on an encrypted connection. We never receive or store your card details.
Products and descriptions
We describe products as accurately as we can, including dimensions, folded sizes and weight limits where the manufacturer publishes them. Photographs are for illustration and small differences in colour and finish are normal. Where a product has a limit worth knowing, such as a maximum user weight, it is on the product page.
Delivery
Delivery terms, costs and timeframes are set out on the shipping page and form part of these terms. You are responsible for giving us an accurate delivery address.
Returns
Your rights if something is faulty, and our own change of mind policy, are set out on the refunds and returns page and form part of these terms.
Your consumer rights
The Australian Consumer Law and the Australian Consumer Law apply to sales to consumers in Australia, and nothing in these terms limits or excludes them.
We do not contract out of the consumer guarantees, and we could not: under section 64 of the Australian Consumer Law a term that tries to exclude, restrict or modify them is void. The Australia equivalent of this shop allows a business-supply exclusion because the consumer guarantees in the Australian Consumer Law permits one; Australian law does not, so no such term appears here.
Liability
The limits of our liability, and what is never excluded, are set out on the limited liability and indemnity page, which forms part of these terms.
Governing law
These terms are governed by the law of New South Wales and of the Commonwealth of Australia, and the Australian courts have jurisdiction. A consumer claim can be taken to your state or territory consumer affairs agency, which for our address is NSW Fair Trading, or to the relevant civil and administrative tribunal.
Changes
The version of these terms published when you place an order is the version that applies to it.
